1. General Rules

The nuts.gift Terms and Conditions (hereinafter referred to as the “Terms”) are for each service provided by nuts.gift (hereinafter referred to as the “Service”) with Mirage B.V. (hereinafter referred to as “nuts.gift”). It is an agreement between all parties and is intended to clarify and streamline how the Service operates. "This service" means that nuts.gift issues and sells electronic tickets (hereinafter referred to as “Ticket”) that can be exchanged for specific products or services (hereinafter referred to as "target products") at specific stores (hereinafter referred to as "target stores") in the online service "nuts.gift" based on this agreement, and to users specified by applicants Service to be delivered.

Those who wish to use this service shall access this service after accepting this agreement. All users of this service (hereinafter referred to as "users") agree to use this service at their own risk. In using this service, users are deemed to have agreed to these terms.

2. Use of Services

• 1. Approval of nuts.gift registration application

  When applying for nuts.gift registration, the user is required to lend the "user ID or password" required to use this service, or the user uses the login linkage function by an external provider supported by nuts.gift. It is considered to have been established at the time of successful login. However, if there is a false statement in the information applied by the user, or if nuts.gift determines that the use of this service is not appropriate, the approval may be cancelled even after approval. In addition, if nuts.gift determines that the use of this service is not appropriate, nuts.gift shall not be obligated to notify the user to that effect.

• 2. Notice or Communication

  nuts.gift will notify users of necessary information by means that nuts.gift deems appropriate, such as nuts.gift's website or sending emails. In doing so, nuts.gift may use the information requested by the user (including information provided to nuts.gift through third-party services based on the user's consent). If such notice is given on the nuts.gift website or by email, it shall take effect from the time it is posted on the website or sent by email. Users shall not be able to refuse notifications by email from nuts.gift, and when users change their own contact e-mail address, they shall immediately follow the procedures for change. In principle, nuts.gift will not respond to contact by telephone, fax, or visit. If nuts.gift sends a contact email requiring a response to the user, the user must respond to nuts.gift by the date specified by nuts.gift. If nuts.gift cannot confirm the reply email, we may cancel the transaction or stop providing the service.

• 3. Registered email address, user ID and password

  The user shall be responsible for the management of the email address notified to this service, and agrees that nuts.gift will not be held responsible for any operation error or unauthorised use by a third party.

• 4. Transfer and sale of rights

  The user shall not transfer, sell, or lend the right to receive this service to a third party without obtaining the prior permission of nuts.gift, and shall not share such rights to the detriment of nuts.gift.

• 5. Communications

  To use this service, you need to access the web. Users are required to prepare means of communication at their own expense and to properly install and operate them. nuts.gift will not be involved in any preparations, methods, etc. before accessing the web.

• 6. Communication volume, range of usage area

  If nuts.gift does not disclose the amount of communication that the user can send and receive through this service, or the area or capacity that can be stored when using this service, the user agrees that nuts.gift sets a certain upper limit for these at the discretion of nuts.gift.

4. Use, Abandonment, Exchange/Return of this Ticket

• 1. After confirming the contents of these Terms in advance, the user shall exchange the Ticket for the target products, and at the time the user exchanges the Ticket for the target products, the applicant is deemed to have agreed to the contents of the Terms.
• 2. Based on the rules or articles of incorporation of the issuer of this Ticket, this Ticket can only be exchanged for eligible products, etc., and cannot be exchanged for cash or for products or services other than eligible products, etc.
• 3. The user may waive all rights related to this Ticket (Including the right to exchange for target products, etc. at target stores) by notifying nuts.gift in the prescribed manner, and the applicant shall not be able to raise an objection to this. After the user receives the above notice, the user may not withdraw or cancel the waiver of rights related to this Ticket.
• 4. After the User applies to purchase the Ticket, the application to purchase the Ticket cannot be withdrawn, returned or exchanged, except in the following cases.
• a. When it becomes impossible to exchange this Ticket for the target product, etc. due to the suspension of this service
• b. If it becomes impossible to exchange this Ticket for the target product, etc. due to a system failure.

5. Gift Expiration Date

The gift expiration date of this Ticket will be 180 days after the issue date of this Ticket. However, for some products with different expiration dates, please check the expiration date on each product page.

6. Prohibitions

• 1. Regarding the use of this service, nuts.gift prohibits acts that fall under or may fall under the following acts. If the user engages in prohibited acts, use will be suspended without notice, or take all legally possible measures or procedures, and if nuts.gift or a third party suffers damages based on prohibited acts, the user shall compensate for this.
• 2. Acts that violate these Terms
  • 1. Applying false registration information when logging in or purchasing
  • 2. Acts of using the service by falsifying one's identity
  • 3. Acts that interfere with the operation of this service, or other acts that may interfere with this service
  • 4. The act of using this service by illegally using a credit card
  • 5. Acts of illegally using e-mail addresses and passwords
  • 6. Acts that cause inconvenience, disadvantage or damage to other users, third parties or our company, or acts that may cause them
  • 7. Acts contrary to public order and morals and other acts that violate laws and regulations, or acts that are likely to do so
  • 8. Acts of fraudulently applying for or holding multiple membership registrations
  • 9. Other acts that the Company reasonably determines to be inappropriate

7. Disclaimer

nuts.gift does not take any responsibility for the following items.

• 1. A contract concerning the provision of the Target Products, etc. shall be concluded between the User and the Target Store. In the event of a dispute between the user, the target store, the issuer of this Ticket, and a third party (including cases where there is a defect or fault in the target product, etc., or the delivery of the target product, etc. is delayed),shall be resolved between the parties to the dispute, and nuts.gift does not take any responsibility. In this case, the member, etc. who is the party to the dispute shall be responsible for compensation for the damage suffered by the member, etc., and nuts.gift shall not be held responsible.
• 2. We cannot make any promises regarding service continuity. The service itself may be suddenly discontinued. (Although we will continue to make efforts, it may not be possible due to various circumstances). In addition, we may individually refuse to use it without prior notice. Please be aware of this before using.
• 3. Nuts.gift is not responsible for any trouble that may occur while using this service. The user is responsible for the management of the content, and therefore, even if the user suffers any damage through the use of this service, compensation for damages will not be provided.
• 4. If the user's actions infringe on the rights of nuts.gift, other users or third parties, or interfere with the use of the Ticket, nuts.gift will freeze or delete this Ticket without warning at its discretion. However, nuts.gift shall not be held responsible for any freezing or deletion.
• 5. nuts.gift does not take any responsibility for data loss due to system failure, file corruption, etc. The data related to this Ticket shall be backed up by the user themselves, and nuts.gift does not guarantee the completeness or safety of any data related to this Ticket.
• 6. Personal information such as address, name, email address, telephone number, fax number, etc. (hereinafter referred to as "personal information") presented to nuts.gift on the web by the user will not be disclosed to third parties without the consent of the user. However, personal information may be disclosed to third parties in the following cases.
  • - When we receive a formal inquiry request based on laws and regulations from a public institution such as a court or the police.
  • - When it is recognized that there is an imminent danger to human life, body, property, etc. and there is an urgent need.
  • - When it is deemed necessary to disclose or share information in order to provide services desired by the user.
  • - When a company entrusted with work by nuts.gift needs information for the purpose of providing services to users. (Such companies cannot use the personal information provided by nuts.gift beyond the necessary limits for the above purposes.)
  • - If the user's behaviour on the nuts.gift site violates the terms of use and is deemed necessary to protect the rights, property, services, etc. of nuts.gift.
  • - In case the user’s actions on the nuts.gift site violate the terms of use, infringe on the rights, properties, services, etc. of third parties, and are deemed necessary to protect the rights, properties, services, etc. of third parties.
  • - When the user's actions on the nuts.gift site are deemed necessary for SEO of nuts.gift or for the prevention or recovery of deterioration in the quality of the services of nuts.gift.
  • - When a payment company used by nuts.gift makes an inquiry or chargeback to nuts.gift about the details of the transaction, it is necessary to disclose the details of the transaction.
• 7. If external information can be accessed from a Ticket within the Service (such as a link included in an email sent to the User upon issuance of the Ticket), the User and the User shall ensure the safety and integrity of the external information. You and the User acknowledge and agree that nuts.gift shall not be liable for any loss or damage arising out of any reliance on accuracy.
• 8. nuts.gift shall not be held responsible for any damages or losses suffered by the user as a result of using, not being able to use, or not using this service.
• 9. The Service is operated from the Kingdom of the Netherlands by nuts.gift. nuts.gift makes no representations as to whether the Service is appropriate or available for use outside of the Kingdom of the Netherlands. You access and use the Service on your own initiative, even if you are accessing it from another jurisdiction, and you do so in compliance with local laws and at your own risk.

8.Withdrawal

The user shall be able to terminate the use of this service and withdraw from this service by the method specified by this agreement and nuts.gift.

If the user withdraws from this service, the user shall lose all rights, including the right to use all services of nuts.gift, the right to win prizes in campaigns, etc.

Nuts.gift will not support the return of this service after withdrawal.

9.Changes in Service Specifications, Suspension, and Cancellation

• 1. nuts.gift shall be able to change the system of this service without notifying the user in advance.
• 2. nuts.gift may pause or suspend the operation of this service due to force majeure such as maintenance work, system restoration, power outages or natural disasters, or other unavoidable reasons. In that case, we will notify you in advance, but this does not apply if it is urgent and unavoidable.
• 3. Nuts.gift reserves the right to change the content of the Service, or to suspend or terminate part or all of the Service at any time at its own discretion. After termination or deletion of this service, nuts.gift may, at its own discretion, delete posts and other information stored on nuts.gift or a third party server operated by nuts.gift.
• 4. If this service is terminated prematurely, nuts.gift shall not be liable for damages to the user, regardless of the cause of termination.

10. Limited Warranty

Nuts.gift shall make every effort to maintain the stability of this service, operation, use, and results of use, but does not guarantee the following.

• 1. The Service shall continue to operate at all times without any temporary suspension.
• 2. In the event of a defect in this service, it will always be restored and repaired in its original state.
• 3. There shall be no destructive components such as computer viruses in the Service.
• 4. Provide a security method to fully ensure 1 to 3.

11. Force Majeure

In the event of failure due to causes beyond a party's reasonable control, including but not limited to natural disasters, inaction of authorities, fire, strike, flood, epidemic, riot or act of war, any neither party shall be liable for any delay or inability to perform its obligations under this agreement for any reasons.

12. Dispute Resolution

• 1. These Terms shall be governed by the laws of the Kingdom of the Netherlands.
• 2. Any disputes or claims arising out of the use of the Service shall be resolved by arbitration procedures recognised in the Kingdom of the Netherlands.
• 3. Disputes or claims not resolved through arbitration shall be resolved in court, in which case the Dutch District Court shall have exclusive jurisdiction as the court of first instance.
• 4. Attorney's fees for arbitration and litigation shall be borne by each party.
• 5. Even if any provision of these Terms is held invalid or unenforceable by a court, the provisions other than such provision shall remain valid and apply.

13. Ad display

• 1. Transactions with advertisers who are advertising or promoting displayed in this service are the responsibility of the user and the advertiser. nuts.gift is not responsible for any damage caused by advertisements posted on the service or damage caused by the posting itself.
• 2. nuts.gift may make changes without prior notice regarding specifications such as ad space, ad display position, display period, etc. Users and end-users shall consent to this.
